Vad har hänt?

Här kommer en uppdatering med anledning av de senaste dagarnas uppmärksamhet kring Flickaplattformen vill vi säga att vi förstår att ni är upprörda, det är vi med. Vårt svar har dröjt för att vi har varit tvungna att utreda vad det är som har hänt och hur det kunnat ske.

Detta har hänt:
Under söndagen den 11 december så publicerades ett videoklipp där en person har uttalat sig om situationen och rapporteringen av händelserna i Iran. Detta skedde under ett FN möte, “Fifteenth session of the Forum on Minority Issues” som ägde rum mellan den 1-2 december 2022 i Genéve. Under mötet presenteras personen som en representant för vår förening, Flickaplattformen, och benämns även som sådan under eventets talarlista.

Personen i fråga har tidigare varit deltagare i Flickaplattformens aktiviteter och personens vårdnadshavare kontaktade vår förening i november och önskade ett intyg om deltagandet. I intyget beskrivs endast personens tidigare deltagande i våra aktiviteter. Detta intyg skickade vi till vårdnadshavaren.

Den 11 december 2022 fick vi detta videoklipp skickat till oss och vi började direkt undersöka vad som hade hänt.

Flickaplattformen har aldrig godkänt att denna person ska representera oss i mötet eller få uttala sig å föreningens vägnar. Dessutom stämmer inte personens uttalande överens med Flickaplattformens ståndpunkter, värderingar och värdegrund.

Flickaplattformen blev heller aldrig tillfrågade från ansvariga organisatörer i FN om personen i fråga skulle representera vår förening under mötet. Vi som förening har inte haft någon som helst kännedom kring detta och fått information om videoklippet och uttalandet samtidigt som allmänheten.

Detta gör vi nu: 

Flickaplattformen har nu kontaktat ansvariga organisatörer för evenemanget för att gå till botten kring hur detta kunde ske utan vår vetskap. Vi har kontakt med vår jurist. Vi har också samtalat med målsman och personen som uttalat sig.

Uppdatering 2022-02-09
Svar från FN
Flickaplattformen fick i början av januari ett kort svar från FN. Anledningen till att det dröjt tills nu, 9 februari, tills vi publicerar något är för att vi inte kände oss nöjda med svaret vi fick. Vi hade hoppats på att kunna ge en mer utförlig förklaring till hur detta kunnat hända och även fått ta del av ansökan. Nu anser vi att det gått så pass lång tid med utebliven återkoppling att vi ändå väljer att publicera det svar vi fått.

Kort skriver arrangören av UN Forum on Minority Issues att de har plockat bort kopplingen mellan talaren och Flickaplattformen på sin hemsida. Detta för att klargöra att talaren inte är en representant från vår organisation.

De skriver också att den som registrerat sig som talare för eventet ska tillhandahålla ett officiellt intyg från sin organisation som visar att deltagaren har rätt att tala å organisationens vägnar. Vi har svarat FN att vi inte har skrivit ett sådant intyg och att vi därför vill ha tillgång till de dokument som personen skickat in. Vi har dock inte fått någon återkoppling av FN på detta och är således inte säkra på hur detta kunnat hända. Det intyg som Flickaplattformen skrev på målsmans begäran innehåller inget medgivande eller ens en antydan på att personen har rätt att föra Flickaplattformens talan. Intyget bekräftar endast att personen varit deltagare i några av föreningens aktiviteter under 2021.

Kommer ni att polisanmäla händelsen nu?
Vi har fortfarande inga rättsliga grunder att stå på för att göra en polisanmälan. Eftersom vi inte har fått tillgång till det underlag som personen skickat in med sin ansökan att få tala på eventet så kan vi inte hävda att det rör sig om en förfalskning.

Hur kunde detta hända?
I dagsläget vet vi inte hur det här har kunnat ske och just nu lägger vi alla våra resurser på att undersöka hur någon har kunnat ta sig in på detta FN-möte och uttala sig i vårt namn. Som del av detta behöver och kräver vi svar från FN, som vi i nuläget inte har fått. Vi ser mycket allvarligt på denna händelse och gör allt vi kan för att uppmärksamma FN på att sådana här misstag inte får ske. Det är jätteviktigt för oss att belysa detta då det ger upphov till stor skada både för oss som förening och för personer som är drabbade av konflikten i Iran. Vårt fokus är att uppmärksamma FN på detta så att det inte under några som helst omständigheter drabbar någon annan. 

Är personen representant för/anställd hos er förening?
Nej, representanter för vår förening är endast våra invalda styrelsemedlemmar. Flickaplattformen har i dagsläget ingen anställd personal utan drivs helt ideellt.

Står Flickaplattformen bakom åsikterna i uttalandet?
Nej, personens uttalande speglar inte vår förenings åsikter, vi tar starkt avstånd från detta uttalande och står i solidaritet med flickors* kamp för sina fri- och rättigheter. Vi står med folket i Iran och jobbar för flickors* rättigheter i hela världen. 

Är personen medlem i er förening?
Nej, Flickaplattformen är en organisation som samlar ideella föreningar, som arbetar för flickors* och kvinnors rättigheter, som medlemmar. Du kan alltså inte vara medlem i föreningen som privatperson. Med det sagt är personen som uttalar sig inte medlem i Flickaplattformen. 

Har ni anmält den här personen till FN mötet? Har ni betalat personens resa?
Nej, vi har begärt ut anmälan till mötet från FN men ännu inte fått något svar från dem. Vi som förening har alltså inte anmält personen i fråga, utan personen har själv anmält sig. Eftersom vi inte har anmält personen till detta mötet eller skickat personen som representant har vi heller inte bidragit ekonomiskt till resan.

Hur har personen blivit inbjuden till FN? 
Personen har inte blivit inbjuden, utan har själv anmält sig till mötet. 

Har ni/kommer ni att polisanmäla personen i fråga? 
Nej, efter samtal med vår jurist har vi beslutat att inte polisanmäla. Detta för att det inte finns någon rättslig grund att stå på, eftersom en organisations identitet inte kan “kapas” på samma sätt som en privatperson. Enligt vår jurist är desinformation och personliga åsikter inte en brottslig handling, med hänvisning till yttrandefriheten, vilket också gör att vi inte kan gå vidare med någon anmälan.

Varför tar ni bort kommentarer med personens namn?
Eftersom personen i fråga är minderårig väljer vi att ta bort kommentarer där personens namn publiceras. Vi som förening är medvetna om vem personen i frågan är.

Kan ni lämna ut intyget som ni har skrivit?
Vi kommer inte att lämna ut en privatpersons personliga intyg till någon annan än den personen eller dennes målsman med hänvisning till GDPR-lagstiftningen och för att värna om den personliga integriteten. 

Handlingarna omfattas av offentlighetsprincipen, kan ni skicka dem till mig?
Vi har ännu inte fått något svar från FN om vilka handlingar det är som har skickats in med ansökan. Då Flickaplattformen är en ideell förening och omfattas vi inte av offentlighetsprincipen som endast gäller offentliga aktörer. Vi kommer därför inte att lämna handlingarna om vi får dem från FN med hänsyn till GDPR lagstiftningen och för att värna om den personliga integriteten. Vill du ha dessa handlingar får du därför själv höra av sig till FN för att begära ut dem.

Hur går ni vidare med detta?
Vi har i dagsläget kontaktat FN för att få svar på hur detta kunde ske utan att vi som förening fick någon som helst information. Vi inväntar svar och kommer ta det vidare därefter. Vi har även samtal med vår jurist.

Here is an update following the last few days’ attention to Flickaplattformen. We want to make it clear that we understand your anger and frustration, we are also angry and frustrated. Our response has been delayed as we have had to investigate what exactly has occurred and how this could happen. 

What Happened: 

On Sunday, December 11th 2022, a video was published where an individual spoke about the situation in Iran and the reporting thereof. This occurred during a UN meeting, the “Fifteenth session of the Forum on Minority Issues”, which took place on the 1st and 2nd of December 2022 in Geneva. During the meeting the person is introduced as a representative of our organization, The Girl Child Platform (Flickaplattformen), and is also named as such on the event’s list of speakers. 

The individual in question has previously participated in Flickaplattformen’s activities and their guardian contacted our organization in November to request a certificate of participation. The certificate only mentions the individual’s previous participation in our activities. This certificate was sent to the individual’s guardian.  

On December 11th, 2022, we were sent the video clip and immediately began investigating what had happened. 

Flickaplattformen never authorized this person to represent us in the meeting or express themselves in the name of the organization in any way. Additionally, the individual’s statement is not in line with Flickaplattformen’s position and values.

Furthermore, Flickaplattformen were never contacted by the responsible organizers from the UN to ask whether the person would represent our organization during the meeting. We as an organization have had no knowledge of this and received the information about the video and the statement at the same time as the general public. 

Our Next Steps: 

Flickaplattformen has contacted responsible organizers for the event to get to the bottom of how this could happen without our knowledge or approval. We are in contact with our legal adviser and have spoken to the person in question and their guardian. 
 

FAQ: 

Update February 9th

Response from FN
In the beginning of January, Flickaplattformen received a brief response from the UN. The reason we have not published this until now, February 9th, is because we have not been satisfied with the answer that we received. We were hoping to provide a more in-depth explanation of how this could have happened and to get access to the application that was sent in. However, given the amount of time that has now passed without a further response, we have chosen to publish the answer that we did receive.

In brief, the organizers of the UN Forum on Minority Issues wrote that they have removed the connection between the speaker and Flickaplattformen on their website, in order to clarify that the speaker is not a representative of our organization. 

Further, they wrote that those who registered as speakers for the event were to submit an official certificate from their organization to show that they were permitted to speak on their behalf. We have responded to the UN that we have not provided such a certificate, and that we would like access to the document that the person submitted. However, we have not received a further response from the UN regarding this and are thus not sure how this could happen. The certificate that Flickaplattformen wrote at the request of the individual’s guardian did not contain any form of authorization for the individual to speak on our behalf. The certificate only confirmed that the individual had participated in some of the organization’s activities during 2021.

Will you report the incident to the police now?
We still lack legal ground to be able to report the incident to the police. Because we have not gained access to the document the individual submitted as part of their application to speak at the event we cannot claim that this was an act of fraud.

Update December 12th

How could this happen? 
We currently do not know how this could have happened, and are dedicating all our resources to investigating how someone has been able to gain access to a UN meeting and speak in our name.

As a part of this we need, and are demanding, answers from the UN, which we have not received at the time of writing. We take this incident very seriously, and are doing everything in our power to make the UN aware of the gravity of the situation. It is very important for us to draw attention to this, as such incidents cause immense damage to us as an organization and, most importantly, the people who are affected by the conflict in Iran. Making the UN aware of this is our priority, so that it doesn’t, under any circumstance, happen to anyone else. 

Is the individual a representative of, or employed by, your organization? 
No, the only representatives of our organizations are the elected members of the board. Flickaplattformen currently does not have any employees, but is run on a fully voluntary basis. 

Does Flickaplattformen support the opinions expressed in the statement? 
No, the individual’s statement does not reflect our organization’s views. We strongly condemn the views expressed therein and stand in solidarity with girls’ fight for their freedoms and rights. We stand with the people of Iran and work to further girls’ rights around the world. 

Is the individual a member of your organization? 
No, Flickaplattformen is an umbrella organization collecting other non-profit organizations, who work to further girls’ and women’s rights, as members. Private individuals cannot be members of the organization. Hence, the individual in question is not a member of Flickaplattformen. 

Have you registered this person for the UN Meeting? Have you paid for the individual’s trip? 
No, we have requested a copy of the individual’s registration for the meeting from the UN but have not yet received a response. Our organization has thus not registered the person in question, but the individual has done this themselves. As we have not registered the individual for the meeting or sent them as a representative we also have not financially contributed to this trip in any way.  

How has this person been invited to the UN? 
The individual has not been invited, but registered themselves. 

Have you/will you file a police report against this person? 
No, following communication with our legal advisor we will not file a police report. There is no legal basis for a police report, as an organization’s identity cannot be “stolen” the same way a private individual’s can. According to our legal advisor, misinformation and personal opinions are not a crime, falling under freedom of speech laws. As such, we cannot file a police report. 

Why are you removing comments containing the individual’s name? 
We are choosing to remove comments containing the individual’s name because the person in question is a minor. We as an organization are aware of who the individual is. 

Can you publish the certificate that you wrote? 
We will not be sending a private individual’s certificate to someone other than themselves or their guardian. This is in line with GDPR legislation and for privacy reasons. 

These documents are covered under the public access principle, can you send them to me?
We have not yet received a response from the UN regarding what documents were sent in with the application. As Flickaplattformen is a non-profit organization the public access principle does not apply to us, but only to public sector actors. For these reasons we will not be sending out the documents if we receive them from the UN, in line with GDPR legislation and for privacy reasons. If you would like to receive these documents you are welcome to contact the UN yourself to request them.

What are your next steps? 
We have contacted the UN to get answers to how this was able to happen without us having received any organization whatsoever. We are currently awaiting a response and will take further steps following this. We are also in contact with our legal advisor.
